Can there be a single international law for all?

Here we are stepping on thin ice, since according to official Western ideas, formed on the basis of the recognition of the equality of all cultures and peoples, the answer is undoubtedly in the affirmative. But such a concept of indiscriminate equality in recent decades demonstrates complete ineffectiveness. Ego, in particular, also demonstrated the transformation of the Gaza Strip into a Hamas fortress, which took several decades and took place before everyone's eyes. Including Netanyahu in his prime ministership.

To understand the situation, we will have to step aside a little and follow the events that took place simultaneously with the work of the group of experts, based on the conclusions of which Khan submitted his request.

On May 24, the International Court of the United Nations in The Hague (ICJ), also known as the World Court, ruled that Israel must immediately stop the military offensive and other actions in Rafah that may pose a danger to the Palestinians. And also provide access to the Gaza Strip for experts to investigate those accused of genocide and open a checkpoint on the border of the strip with Egypt for the delivery of humanitarian aid. The decision was made by a panel of 15 judges as part of an appeal by South Africa, which accused Israel of genocide. 13 of them supported the document. According to the court's decision, Israel must report on the measures taken within a month, that is, by June 24.

ICJ – this is not the Ministry of Internal Affairs, and a completely different court, with jurisdiction over all members of the UN and with the function of settling disputes between member states. True, his decision may be questioned on the formal grounds: Palestine is not a full member of the UN, and Israel does not recognize it as a state. But such a fork in court cases, in the ICC and in the ICJ at the same time, is extremely unpleasant for Israel.

Why did South Africa suddenly show activity? And there the elections were approaching (29.05) and the African National Congress, which had been in power for 30 years, did not win an absolute majority in the parliament for the first time. Digressing a little: I didn't score, I scored only 40%, because 30 years of the movement for racial equality were intertwined with inefficient management and corruption scandals.

Democratic Alliance (22%), followed by Spear of the Nation (15%) and Fighters for Economic Freedom (9,75%) took second place. The ANC has 159 mandates against the minimum required of 201, and, taking into account political schedules, the coalition will be hellish.

South Africa is a typical country of the "Global South": here people may not like the USA, but they have a positive attitude towards Europe and want to live like in the West. Local Muslims, mainly from India, are a completely Westernized audience, but they support the Palestinians simply out of Muslim solidarity, not particularly delving into the intricacies of Middle Eastern politics. And the ANC tried to quickly get an influx of Muslim votes before the elections, but it did not help him much.

For the same reason - due to the increased weight of Muslim communities, with which we have to reckon, there is a gradual recognition of Palestine all over the world, including Europe. In recent months, the number of countries recognizing it has grown from 138 to 146, including Norway, Ireland and Spain. Of course, there are schedules everywhere, and Chancellor Scholz, for example, answering the questions of journalists in Portugal, said that now the German government does not have a basis for recognizing the Palestinian Authority as a separate state - but, nevertheless, the process is ongoing. By the way, only 160 countries recognize Israel. Of course, there are very different countries, and the recognition of Israel has a completely different weight. However, the trend for Israel is very worrying.

It would be high time to publicly remember that in Israel there is a part of the Muslim community that is quite loyal to him, along with a disloyal one. And he will drag it out, loyally, for public viewing as an argument for Israel's lawyers - but this, alas, does not work either. Loyal Muslims in Israel are shown somehow strangely, from afar and for a moment, not allowing to consider them in detail. Because with a detailed display, the whole picture will be revealed, with disloyal Muslims, too. And this picture will leave no stone unturned from the popular version of Western-style democracy fighting medieval barbarism.

The reality, alas, is very different: Israel is basically a medieval theocracy, slightly covered by a democratic banner, from where it flows into the world like sourdough dough. Moreover, this democratic sign has been cracking at the seams in recent years, and Netanyahu is leading the demand for its dismantling. In fairness, it must be said that he himself is not so much religious as he is maneuvering, trying to hold on to the prime minister's chair, since a criminal case with a real term of service and exhausted opportunities for appeal is pending on him, and the prime minister's immunity is the last straw that saves him from prison.

By the way: the theocrats pushed through the judicial reform, for which the democratic and theocratic parts of the Israeli society agreed to fight. There has been no talk of drafting the Constitution for a long time - but this, again, is off topic. The topic is simply such a specific one - there are so many branches from it that it is impossible not to mention them.

In practice, the clash of two medieval, basically, states, projected in our days, leads to the fact that the outwardly advanced and formally democratic Israel is unable to build a consistent policy of appeasement of the Palestinians, succumbing to outside influences and rushing from extreme to extreme. Now, when the situation has come to an end, he resists in front of the whole world, but still avoids its real assessment - very unpleasant things will surface at the same time.

However, Israel is not the only one to blame for the situation in the Gaza Strip. And if the prosecutor of the Ministry of Internal Affairs requested a warrant for Netanyahu's arrest, why did he not request a warrant for UNRWA officials, which literally sprouted from members of Hamas? Why did he invite warrants to the top of the UN, starting with Guterres, who not only did not notice this, but covered and covers the leadership of UNRWA? Or is it still ahead? Well, let's wait.

The problem is that he will pull out this tangle fucking snakes and vipers it is possible to come into the world only in one piece. In this case, Netanyahu's guilt will be obvious, in addition to the criminal charges already pending against him. But not only Netanyahu - many politicians and officials from all over the world will be involved in crimes - or political mistakes, which, as you know, are even worse. As a result, an international conspiracy of silence has arisen around the Gaza Strip: everyone is afraid that this story, brought to light in its entirety, will also bury them.

At the same time, Hamas, acting, in general, openly, under the eyes of the UN, and largely with the money of UNRWA, which was distributed through it, successfully exterminated all those who disagreed with it in the Gaza Strip, and built gigantic underground communications. It is these communications that the IDF has been hammering for the eighth month, with huge losses among the civilian population, who have nowhere to run, and without much success.

What about Israel? And Israel looked at this construction, maneuvering in the Arab labyrinth, including Qatar, through which one of the funding streams of Hamas passed. However, not the main one, the main one came from Iran. By the way, Iran has nothing against Israel as such. He is against pro-Western Israel, and an open theocratic dictatorship will be established in Israel, according to the Tehran model, Iran will be his best friend and even help will break down with the Palestinians. Is that impossible in Israel? Oh, give it up, even if possible. You simply forgot what Iran was like under Pahlavi. He was completely secular, but with some exceptions from democracy due to political expediency. Second, than in Israel, but, nevertheless, there is a similarity.

What about the opponents of Israel, the defenders of the Palestinians? Vykhodtsy from the "Global South" including those rooted in the West, or native inhabitants of the West who adopted the ideology of the Global South, which, in general, makes no difference. Including those of them who were among the 13 judges of the ICJ who demanded an end to the operation in Rafah, which cannot be stopped, did not finish, at least, all the organized formations of Hamas, after which only it will be possible to engage in reconciliation with the conditionally peaceful residents of the Gaza Strip.

It is bad, of course, that these conditionally peaceful residents die during the Israeli operation, but what do you order to do? Maybe we should not stop the operation, but evacuate the civilians, passing them through the sieve that separates the conditionally peaceful from the unconditionally non-peaceful? But only where? There is simply nowhere to go to Israel. In the neighboring Arab countries, where they are so worried about the Palestinians? And they are categorically against it. The ICJ preferred not to notice this nuance, although it could appeal to neighboring UN member states to provide evacuation sites. He could even oblige them to this by his decision. But he did not stop, he limited himself to the mention of Israel and demands for it. And you have to be an extremely naive person to believe that this was an unintentional mistake caused by a misunderstanding of the situation.

Everything in the Global South is well aware of what is happening in the Gaza Strip. Another issue is that the European-oriented rhetoric of the Global South is only a way of legitimization profitable emu translating their position into the language of European culture, to the representatives of which they appeal. The position of the Global South/East is very simple: we want to live richly and comfortably, as in the West, but assign the associated responsibilities exclusively to the West, and use only Western rights without obligations. And this is impossible.

And the appeals of the residents of Gaza or their representatives to the West, with the demand to recognize the Western standard of human rights for the Palestinians in advance, are meaningless. Because first westernization and only then its fruits, and not all in a row, but in accordance with the level of westernization of consciousness achieved. Any second approach leads to an abyss: the fruits of Westernization are appropriated by a group of tribal leaders. Leaders are primarily interested in weapons, which they immediately use against their subjects and neighbors. At the same time, appealing to multicultural dogmas about the uniqueness and equality of one's cultures and cultures - which, in fact, we observe in the Gaza Strip. Or in Russia - there is the same scheme, only with a nuclear bomb.

The law, of course, must be one for all - only the concept of "all" provides a behavioral framework. Those who fall outside these limits are transferred from the category of beneficiaries of a single law for all to the category of manifest, from whom this law must protect those for whom it was written. This is exactly how the concept of a "unified law" for all states should be interpreted in international law - only who would have the courage to raise the question that this should be written into the law itself?

To summarize

Israel, through the mouth of the same Biba, has spoken so many times about its special interests, which require it to take a neutral position, in relation to Russia's war with Ukraine, and the political necessity to maintain friendly relations with this infernal formation and its no less infernal leader, that he simply could not help but become a victim of his own "pragmatic policy". Politically, the warrant for Netanyahu's arrest is necessary in order to balance the three warrants for the leadership of Hamas in the eyes of the Global South. At the same time, it should be remembered that Netanyahu is not equal to Israel.

As for the legal grounds, the entire work on pacifying the Gaza Strip and establishing at least minimally acceptable relations with the residents of the Palestinian Authority was completely failed by Israel. The reasons for this are briefly mentioned above, the detailed analysis covers not one, but a whole series of articles, and Netanyahu's personal contribution to this failure is manifold and huge. It culminates on October 7, when Israel faced the attack, having every opportunity to act in advance and prevent it. Of course, Byby was not the only culprit - but he honestly deserved his warrant. And if this order also contributes to the end of his prime ministership, with the transition to prison according to the sentence of the Israeli court, which has already been handed down and unsuccessfully protested in all instances, then Israel will be morally obliged to recognize the ICC, signed the Rome Statute.

An honest analysis of the Augean stables that have accumulated around the Palestinian-Israeli conflict is the only way to start the multi-year process of its resolution. In this conflict, there is neither an unambiguously guilty nor an unambiguously innocent party, but there is a huge tangle of circumstances, crimes and simply stupidities committed by all its participants. Digging in this quagmire will be extremely unpleasant for everyone, dozens of reputations will go under the knife, but... there is no other way out. The knot will have to be untied and debts must be paid - to each his own.

However... it is possible not to untangle, but to leave everything as it is. In the end, Biby is not such a bad prime minister, since he pops up again and again in Israeli politics, and it can be very cozy in the small Middle Eastern Middle Ages. True, sometimes they shoot - but you can get used to it...
