Good evening! I was interested in Yu. Chernetsky's materials, since the topic of territorial communities at the state level is suspended in the air, rather it preserves the Soviet position. This is evidenced by the methodological recommendations issued by the Ministry of Regions in February 2019 to the Statutes of territorial communities, where self-governing bodies rise above the community (usurp power), which is happening everywhere in Ukraine. And in October last year, the Verkhovna Rada of Ukraine adopted the draft law on the capital of Ukraine in the first reading. Newly appointed deputies, trying to satisfy the interests of their customers, violated the Constitution of Ukraine and Art. 4 of the European Union Charter, and much more. The most remarkable thing is that the current deputies have no idea about the RIGHTS of the community, completely ignoring them. On the other hand, more and more citizens are turning their faces towards the theme of the community. At the same time, it should be noted that, as a rule, this is fragmentary knowledge, very far from practice and existing legislation. I would like to shed light on the state of civil society in Ukraine and the problems of its development. The National Institute of Strategic Studies prepared a 112-page report on this topic. The public presentation did not take place due to the general quarantine. But this topic requires close attention, since the National Strategy for the Development of Civil Society, approved by Decree of the President of Ukraine No. 68/2016, has completely failed. budgets, and the Cabinet of Ministers coordinates all these actions. Isn't it interesting to understand why this kitchen does not cope with the task. For two reasons: 1. officials do not need it, and society simply has not matured to the 21st century. Although naive Zh.Zh. Rousseau declared the phenomenon of civil society back in the 18th century. The most interesting thing is that the developers of the National Strategy ignored the fact that territorial communities are the basis of civil society. All the schoolchildren of Paris know about this, and the developers of the Strategy wrote about anything, except the formation of territorial communities, although all their arguments in favor of civil society are based on the principles of self-government. And as you know, local self-government is a RIGHT of territorial communities (Article 140 of the Civil Code). In addition to what has been said, it can be added that the Kyiv Council adopted a decision "On the approval of the Concept of the Statute of the Territorial Community of the City of Kyiv" dated 20.12.2017 No. 707/3714, where in the "Problems of the TG" section it is written: "Factors requiring the modernization of the existing today in the city of Kyiv models of local self-government:
- lack of subsidiarity and real decentralization in the city - the territorial community of the city of Kyiv, in fact, has a secondary character compared to other entities of the city government, which contradicts the Constitution of Ukraine and all international standards of local self-government;
- the current Statute is not a document that contributes to the process of formation of the territorial community of the city of Kyiv, that is, a municipal community (and not just a mathematical aggregate, as it actually is today) - Kyivans united by the need to solve common issues."
And what happened in the city of Kyiv after the public recognition of the violation of the CU - this suicide? Nothing! No one even lifted a finger. Although the head of the state administration of Kyiv, the President of Ukraine, as the guarantor of the CU, should have been relieved of his duties a long time ago.
But it's not the mayor of Kyiv. It's a matter of principle. There is no organized community! Not available in all of Ukraine!
